These provisions govern the use of the Internet portal service (hereinafter, the ‘Portal’) that TRENDING TROPIC makes available to Internet users.

Access to the website is free except for the cost of connection through the telecommunications network provided by the access provider contracted by users. Certain services are exclusive to our customers and access to them is restricted.

The use of the Portal attributes the condition of Portal user (hereinafter, the ‘User’) and implies the acceptance of all the conditions included in this Legal Notice. The provision of the Portal service has a duration limited to the moment in which the User is connected to the Portal or to any of the services provided through it. Therefore, the User must carefully read this Legal Notice each time they intend to use the Portal, since it and its conditions of use contained in this Legal Notice may be modified.

Some Portal services accessible to Internet users or exclusive to TRENDING TROPIC customers may be subject to particular conditions, regulations and instructions which, if applicable, replace, complete and/or modify this Legal Notice and which must be accepted by the User before the corresponding service is provided.

  1. Intellectual and industrial property

All the contents of the Portal, including but not limited to texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound contents, as well as their graphic design and source codes (hereinafter, the ‘Contents’), are the intellectual property of TRENDING TROPIC or of third parties, and none of the exploitation rights recognised by the regulations in force on intellectual property on the same, except those that are strictly necessary for the use of the Portal, may be understood to have been assigned to the User.

The trademarks, trade names or logos are owned by TRENDING TROPIC or third parties, without it being understood that access to the Portal attributes any right over the trademarks, trade names and / or logos.

All information received on the website, such as comments, suggestions or ideas, will be considered ceded to TRENDING TROPIC free of charge. Information that cannot be treated in this way should not be sent.

All products and services on these pages that are NOT owned by TRENDING TROPIC are trademarks of their respective owners and are recognized as such by our company. They only appear on the TRENDING TROPIC website for promotional and information gathering purposes. These owners may request the modification or deletion of the information belonging to them.

  1. Conditions of use of the portal

3.1 General

The User undertakes to make correct use of the Portal in accordance with the Law and this Legal Notice. The User shall be liable to TRENDING TROPIC or to third parties for any damages that may be caused as a consequence of the breach of this obligation.

It is expressly forbidden to use the Portal for purposes harmful to property or interests of TRENDING TROPIC or third parties or in any other way overload, damage or disable networks, servers and other computer equipment (hardware) or products and software of TRENDING TROPIC or third parties.

3.2 Contents

The User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as any other conditions, regulations and instructions that may be applicable in accordance with the provisions of clause 1.

By way of illustration only, the User, in accordance with current legislation, must abstain from:

Reproduce, copy, distribute, make available, publicly communicate, transform or modify the Contents except in cases authorized by law or expressly consented to by TRENDING TROPIC. or who holds the ownership of the rights of exploitation where appropriate.

Reproduce or copy for private use the Contents that may be considered as Software or Database in accordance with current legislation on intellectual property, as well as its public communication or making available to third parties when these acts necessarily involve reproduction by the User or a third party.

Extracting and/or reusing all or a substantial part of the Contents of the Portal as well as the databases that TRENDING TROPIC make available to Users.

3.3 Data Collection Forms

Without prejudice to the provisions of clause 5 of this Legal Notice, as well as the privacy policies accessible from the Portal and that may be applicable at any time, the use of certain services or applications addressed to TRENDING TROPIC are conditioned upon completion of the corresponding User registration.

All information provided by the User through the Portal forms for the above purposes or any other must be truthful. To these effects, the User guarantees the authenticity of all data communicated and will keep the information provided to TRENDING TROPIC perfectly updated so that it responds, at all times, to the real situation of the User. In any case, the User shall be solely responsible for any false or inaccurate statements made and for any damages caused to TRENDING TROPIC or third parties for the information provided.

To ensure the quality of our portal, we reserve the right to reject any application for registration or to suspend or cancel a previously accepted registration if we understand that it does not meet these requirements or any other law or regulation. If this occurs, we will attempt to state the reasons for our decision, but we cannot undertake to do so in all cases.

3.4 Introduction of links to the Portal

Internet users who wish to introduce links from their own web pages to the Portal must comply with the conditions detailed below without the ignorance of them avoiding the responsibilities arising from the Law:

The link will only link to the home page or main page of the Portal but may not reproduce it in any way (online links, copy of texts, graphics, etc.).

It will be forbidden in any case, in accordance with applicable legislation and in force at any time, to establish frames or frames of any kind that involve the Portal or allow the display of Content through Internet addresses other than those of the Portal and, in any case, when viewed together with content outside the Portal so that: (I) produces, or may produce, error, confusion or deception in users about the true origin of the service or Content; (II) involves an act of comparison or unfair imitation; (III) serves to exploit the reputation of the brand and prestige of TRENDING TROPIC; or (IV) in any other way is prohibited by law.

No false, inaccurate or incorrect statements about TRENDING TROPIC, its partners, employees, customers or the quality of the services it provides shall be made from the page that introduces the link.

Under no circumstances shall it be expressed on the page where the link is located that TRENDING TROPIC has given its consent for the insertion of the link or otherwise sponsors, collaborates, verifies or supervises the services of the sender.

The use of any word, graphic or mixed mark or any other distinctive sign of TRENDING TROPIC within the sender’s page is prohibited except in cases permitted by law or expressly authorized by TRENDING TROPIC and provided that, in these cases, a direct link to the Portal is permitted in the manner set forth in this clause.

The page that establishes the link must faithfully comply with the law and may not in any case have or link to its own content or that of third parties: (I) are unlawful, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.).); (II) induce or may induce in the User the false conception that TRENDING TROPIC subscribes to, endorses, adheres to or in any way supports the ideas, statements or expressions, legal or illegal, of the sender; (III) are inappropriate or not relevant to the activity of TRENDING TROPIC in view of the place, content and subject matter of the website of the sender.

 

  1. Exclusion of responsibility

4.1 Information

Access to the Portal does not imply any obligation on the part of TRENDING TROPIC to check the truthfulness, accuracy, adequacy, suitability, completeness and timeliness of the information provided through it. The contents of this page are of a general nature and do not constitute, in any way, the provision of a legal advice service or of any kind, so that such information is insufficient for personal or business decision making by the User.

TRENDING TROPIC is not responsible for the decisions taken from the information provided on the Portal nor for the damages caused to the User or third parties as a result of actions based solely on the information obtained on the Portal.

4.2 Quality of service

Access to the Portal does not imply any obligation on the part of TRENDING TROPIC to control the absence of viruses, worms or any other harmful computer element. It is the User’s responsibility, in any case, to ensure the availability of suitable tools for the detection and disinfection of harmful computer programs.

TRENDING TROPIC is not responsible for any damage caused to the computer equipment of Users or third parties during the provision of the Portal service.

4.3 Service availability

Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity and operation does not correspond to TRENDING TROPIC. Therefore, the services provided through the Portal may be suspended, cancelled or inaccessible, prior to or simultaneous with the provision of the Portal service.

TRENDING TROPIC shall not be liable for any damages of any kind caused to the User that result from failures or disconnections in the telecommunications networks that result in the suspension, cancellation or interruption of the Portal service during the provision of the same or in advance.

4.4 Content and services linked through the Portal

The Portal access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In these cases, TRENDING TROPIC acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of 12 July, on Information Society Services and Electronic Commerce (LSSI) and will only be responsible for the contents and services provided on the Linked Sites to the extent that it has effective knowledge of the illegality and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, he or she may notify TRENDING TROPIC in accordance with the procedure and effects established in Clause 6, without this communication in any case entailing the obligation to remove the corresponding link.

In no case, the existence of Linked Sites should presuppose the existence of agreements with those responsible for or owning them, nor the recommendation, promotion or identification of TRENDING TROPIC with the statements, content or services provided.

TRENDING TROPIC does not know the contents and services of the Linked Sites and therefore is not responsible for damages caused by the illegality, quality, non-updating, unavailability, error and uselessness of the contents and/or services of the Linked Sites or for any other damage that is not directly attributable to TRENDING TROPIC.

  1. Protection of personal data

The data collected through the data collection forms on the Portal will be incorporated into an automated personal data file for which TRENDING TROPIC is responsible. TRENDING TROPIC will treat the data confidentially and with the purpose of registering them with the Spanish Data Protection Agency for this purpose. Likewise, TRENDING TROPIC will cancel, erase and/or block the data when they are inaccurate, incomplete or have ceased to be necessary or relevant for their purpose, in accordance with the provisions of data protection legislation.
By pressing the “send” “subscribe” button (choose the button that gives rise to the collection of information from the corresponding form), the User consents to TRENDING TROPIC to send information by e-mail or by any other means.  However, the User may oppose the sending of such communications in writing with a copy of his or her tax identification number to the address C/ Barranco de la Cruz s/n Almuñécar (18690), Granada, Spain. In the data collection forms, the fields marked with an asterisk are obligatory, so if the User does not provide the corresponding data, TRENDING TROPIC may, at its sole discretion, deny the corresponding service.

The User may revoke the consent given and exercise the rights of access, rectification, cancellation and opposition by going to the address indicated in clause 1, for this must indicate name, surname, in addition to your photocopy of ID.

Cookies are automatic procedures for collecting information relating to the preferences determined by a user during his visit to a particular website. This information is recorded in small files that are stored in the computer equipment of the user concerned imperceptibly. Each time the user accesses the website in question, these files are automatically activated so that the website is configured with the preferences indicated in previous visits. In short, cookies are physical files of personal information housed in the user’s own terminal and unequivocally associated with this terminal. Cookies cannot read cookie files created by other providers.

The User has the possibility of configuring his or her browser in such a way as to prevent the creation of cookie files or to warn of the moment in which this occurs. The Portal is accessible without the need to activate the options relating to cookie files, although they may prevent the proper functioning of security mechanisms for exclusive services or certain services that require greater security. As a general rule, the purpose of the Portal’s cookie files is to facilitate the User’s navigation.

The server that transmits and activates the automatic collection procedures is valid for 12 months, after which the cookie files are automatically deleted.

  1. Reporting of illegal and inappropriate activities

In the event that the User or any other Internet user becomes aware that the Linked Sites refer to pages whose contents or services are unlawful, harmful, denigrating, violent or contrary to morals, they may contact TRENDING TROPIC indicating the following points:

Personal data of the communicator: name, address, telephone number and e-mail address;

Description of the facts that reveal the illicit or inadequate character of the Linked Site;

In the event of violation of rights, such as intellectual and industrial property, the personal data of the owner of the right infringed when different from the communicator.

Likewise, they must provide the title that accredits the legitimacy of the holder of the rights and, where appropriate, that of representation to act on behalf of the holder when he/she is a person other than the communicator;

Express statement that the information contained in the claim is accurate.

The receipt by TRENDING TROPIC of the communication provided for in this clause shall not imply, in accordance with the provisions of the LSSI, effective knowledge of the activities and / or content indicated by the communicator.

Likewise, they must provide the title that accredits the legitimacy of the holder of the rights and, where appropriate, that of representation to act on behalf of the holder when he/she is a person different from the communicator; express declaration that the information contained in the claim is exact.

The receipt by TRENDING TROPIC of the communication provided for in this clause shall not imply, in accordance with the provisions of the LSSI, effective knowledge of the activities and / or content indicated by the communicator.

  1. Notifications

All notifications and communications made by the parties shall be valid in accordance with the means permitted by law. Those relating to this Portal shall be considered effective, for all purposes, if they are made through the Portal itself.

  1. Modifications

TRENDING TROPIC reserves the right to carry out without prior notice the modifications it deems appropriate in its website, being able to change, delete or add both the contents and services that are provided through the same as well as the way in which they are presented.

On the other hand, these terms and conditions may change at any time. The modifications will come into force from the moment of their publication.

  1. Legislation

This Legal Notice is governed in each and every one of its extremes by Spanish law. For any litigation that may arise in relation to the website or the activity carried out on it, the Courts of Almuñécar shall be competent, the user expressly renouncing any other jurisdiction that may correspond.
